Pre-Nuptial Agreements - Are They Necessary?

  1. Is a pre-nup necessary? This article makes some good points why it is, in certain circumstances. Granted, it's a touchy subject for many. However, discussing death is a difficult subject as well, yet most couples have wills.

    Pre-nups have a bad rap. They give the impression that the parties expect to fail and have therefore put the safeguards into place so that the parties walk away relatively unscathed. However, if addressed in the same "what-if" conversation as budgets, wills, etc. then they do seem more palatable to the average person.

    Having said that, my current marriage is not my first; I do own a business, we each have adult kids from prior marriages and we do not have a pre-nup. However, we do have integrity and I'm quite confident that should a marital breakdown occur, that the two of us would hold fast to our inherent values and not attempt to screw each other financially in the dissolution of our marriage. I've also been divorced and even in the heat of our anger, neither I nor my ex tried to take advantage of the other.

    Alas, not all couples can anticipate this kind of civility. And until we can, I suspect pre-nups will always be necessary. (Although I can think of better ways to spend $2,000-$3,000. How about pre-marital counseling?)

  2. Hi Maureen, Thanks so much for taking the time to share your insight! If a couple decide to get one, they should do so from a business perspective, as opposed to an emotional perspective (just like a will).

    I totally agree with your last point...I would rather spend money on pre-marital counseling (I'm a huge advocate), than on a pre-nup!
